Key things we will do for you when you are selling a property in NSW

commencing your matter

We will prepare your contract and provide it to the selling agent.

 When you accept an offer, we will send the contract to the buyer's solicitor.

 We will arrange for you to sign the contract (usually electronically so you don't need to attend our office in person).

Then we will collect the contract signed by the purchaser and, after checking the purchaser has paid the deposit, we will formally exchange contracts.

progressing your matter

We will let you know when settlement is due to take place (this is the day you receive the money from the buyer and hand over the keys).

 We will respond to questions from the buyer's solicitor about the property (these are known as requisitions on title).

After you let your lender know the property has been sold, we will reach out to provide them with any information they need to discharge the mortgage.

 We will review all the conveyancing documents drafted by the purchaser's solicitor and your lender.

finalising your matter

We will check all the settlement calculations prepared by the purchaser's solicitor.

After paying the balance of any mortgage to your lender, we will deposit the funds into your bank account.

 We will inform you when settlement is complete.

The agent will also be informed they can release the keys to the purchaser and pay the balance of the deposit to you.

At least one buyer must be an Australia citizen or permanent resident.

The purchase needs to be for the whole property (not just a share).

The contract must be dated on or after 1 July 2017.

All buyers must be a natural person (not a company or a trust).

Eligible buyers can receive an exemption from payment of stamp duty for properties valued up to $800,000. This means they do not pay any stamp duty.

Buyers can receive a discount on the amount payable for stamp duty for properties valued between $800,000 and $1,000,000.

Eligible purchasers who buy a vacant block of land will not pay any stamp duty if the land is valued at less than $350,000.

For land valued between $350,000 and $450,000, eligible purchasers will receive a discount on the amount of stamp duty they have to pay.
